The article examines some problematic issues related to the abuse of procedural rights by parties to criminal proceedings, in particular, by the defense. The current Code of Civil Procedure of Ukraine does not provide a definition of "abuse of procedural rights" and does not directly emphasize the prohibition of certain actions by the parties that can be attributed to abuse. The Supreme Court considers the prohibition of abuse to be a general legal principle that applies to all areas of law, and considers abuse to be a factor that negatively affects the equality and competitiveness of the parties. The current CPC defines only three cases that can be considered abuse of procedural rights. However, during the investigation of criminal proceedings, certain "risk zones" constantly arise, where conditions for abuse are created for the parties (prosecution and defense), due to certain shortcomings in the legislation. In particular, these are situations that arise during the opening of materials by the parties in the manner specified in Article 290 of the CPC.This is due, for example, to the inability of the defense to interrogate witnesses, but in accordance with the requirements of criminal procedural law, explanations that a lawyer can obtain as a lawyer are not evidence. The author argues that the defense must disclose the statements received from the witness as a means of collecting or verifying evidence, as a source of evidence in criminal proceedings on criminal offenses. It is proposed to determine a certain algorithm of procedural actions of the lawyer. The author suggests that, along with the prosecutor's indictment, they also submit a "defense act," in which the lawyer would define the defense's position, its justification, his attitude to preventive measures, the possibility of closing the proceedings, draw the court and prosecutor's attention to the shortcomings of the pre-trial investigation, etc. This can make it easier for the court to analyze the materials of the criminal proceedings and ensure real adversarial and equality of the parties.
