This article explores the core concepts and contemporary application of the classical legal remedy for the protection of possessionthe vindicatory claim. The institution of vindication originates in ancient Roman civil law and remains an integral part of the protection of property rights in European legal systems.Since the 19th century, two main doctrinal approaches have existed in European legal theory concerning the concept of possession. The first, proposed by Friedrich Carl von Savigny, is based on the combination of corpus -actual physical control over a thing -and animus -the intention to possess it for oneself (possessio). The second, developed by Rudolf von Jhering, considers only corpus as decisive, but not in the sense of physical possession, rather as a right to possess, understood as visible title or a presumption of ownership.Despite ongoing debates over whether possession is a matter of fact or of right, factual possession has traditionally been the primary basis for possession protection in the context of property law.In contrast to these classical doctrines, the Austro-German legal tradition of the 19th century introduced the concept of book possession (Buchbesitz in German) -a form of possession over immovable property based not on physical control, but on a formal entry in the land register. This approach treats registration as the decisive criterion for protection, downplaying or disregarding physical or actual possession. The differing methodological foundations of these concepts have led to divergent understandings of possession in Ukrainian law.Since 2018, Ukrainian judicial practice -particularly in cases involving vindicatory claims -has increasingly adopted the book possession approach as predominant.Based on the results of the study, the author argues that the exclusive reliance on the concept of book possession, to the neglect of actual or physical possession of immovable property, does not fully comply with current Ukrainian legislation. It disregards the European legal tradition and leads to negative consequences in the practice of law enforcement.
