Abstract: The author reveals the meaning of the concept of abuse of rights in relations preceding labor relations. The paper describes cases when an employee or employer abuses his right. The relevance of the chosen topic is due to the fact that the labor legislation of the Russian Federation does not regulate situations similar to those described. The author pays attention to the specifics of concluding and executing a targeted training agreement, an apprenticeship agreement, analyzes examples of possible abuse of rights in the specified legal relations and concludes, that it is necessary to improve the legislation in the relevant area. The author’s definition of the concept of abuse of rights is proposed, as well as the ways to overcome defects in the labor legislation of the Russian Federation.
