The Main Elements of the Mechanism of Functioning of Human Will and the Will of Society in the State-Legal Sphere

Type: article
Abstract: Introduction: this paper continues a cycle of publications devoted to the study into the phenomenon of will, its essence, role, and meaning in jurisprudence and other fields of theory and practice of human activity. Currently, despite its fundamental importance for the general theory of law, as well as for jurisprudence as a whole, the category of will remains very little studied. This situation testifies to the presence of a serious methodological gap, causing a number of contradictions and defects both at the level of the general theory of law and at the level of branch-specific and applied legal sciences. Purpose: based on the results obtained earlier, to determine the main elements of the mechanism of the functioning of will, to give a brief description of these elements from the position of the internal structure of a person as an energy-informational phenomenon, to provide additional arguments in favor of the existence of collective volitional energy (that of social groups, nations). Methods: general scientific methods (analysis, synthesis, observation, induction, deduction, intuition, etc.), specific sociological methods (participant observation, expert evaluations, survey), psychological methods (reflection of decisions and actions in various situations). Results: the study identifies universal elements of the mechanism of functioning of individual and collective will (subject, or bearer, of will; object of application of will; consciousness, intelligence; attention; intention), provides their brief description, shows their significance for jurisprudence and other branches of knowledge. Conclusion: the topic under consideration is so extensive and complicated that within the framework of one article it is only possible to briefly outline the main elements of the functioning of will in the state-legal and other spheres as a process of movement of the corresponding internal energy. Will is a key characteristic of a person, society, and state, a fundamental element of these systems, so this problem goes far beyond the scope of jurisprudence and requires complex interdisciplinary research
