Historically, the field of dispute resolution has been characterized by a prevailing emphasis on specialization, while access to justice has experienced multiple phases of transformation over the past several decades. This evolution has been propelled by the convergence of consensual and adversarial approaches to dispute resolution, which has played a crucial role in the advancement of justice systems within the judicial framework. Such developments highlight the necessity of institutionalizing administrative mediation. Mediation, recognized as a method of alternative dispute resolution (ADR), has established a firm foundation in the realm of civil and commercial disputes, prompting private law judges to embrace it with confidence. In contrast, the administrative judiciary has exhibited a more cautious stance towards this approach. The belated acknowledgment of mediation as a valid ADR method within public law, in comparison to its integration into private law, can be ascribed to the doctrinal belief that administrative disputes possess distinct characteristics and substance. Nevertheless, mediation in the context of administrative disputes has recently garnered significant attention within both legal doctrine and jurisprudence. Since the early 1990s, the utilization of mediation as an alternative dispute resolution (ADR) mechanism has witnessed a significant increase in adoption. Transformations within justice systems have facilitated the emergence of non-judicial mechanisms for dispute resolution, which can be categorized into those that yield non-binding outcomes—such as conciliation or mediation—and those that result in binding decisions, including litigation and arbitration. This evolution is consistent with the expanding role of the state in overseeing individual activities, under the auspices of safeguarding public order and promoting the general interest—objectives that are fundamental to administrative action. In the domain of international administrative contracts, the methods of dispute resolution have evolved beyond the traditional confines of litigation and arbitration. Numerous judicial systems have demonstrated a propensity for protracted proceedings. Within the Egyptian legal and judicial framework, administrative courts serve as the designated avenue for the resolution of administrative disputes. Their function has been further solidified as an adversarial mechanism, particularly in light of the rising incidence of administrative disputes stemming from the burgeoning number of public legal entities and the broadening of their spheres of intervention.
