Abstract: Artificial intelligence (AI) has great potential for application in special needs tourism, whensoever the rights of people with these needs are duly protected before and during the trip. The objective of this paper, after assessing the advantages and risks of the use of AI in special needs tourism is to verify if European and Spanish regulations are moving towards their protection in the regulatory use of AI in tourism. We have used a descriptive and analytical methodology. There is little reference to this topic in the literature, and insufficient fragmented treatment in the regulations, which is why actions are required by public powers to adapt the regulations, promote inclusive policies in the sector that consider the use of AI, and promote a code of conduct in the tourism sector to guarantee trustworthy use of AI for people with special needs.
