The issues examined in the article are related to the repeated changes in legislative approaches to the concept of compensation for infringement of copyright or related rights, as well as to the criteria for its calculation.Understanding the nature of the compensation in question and all its legislative transformations is important not only from the standpoint of theoretical analysis. It also has practical significance, since compensation is the most commonly invoked remedy in court, and the rule of law applied to its calculation is the one in force at the time the infringement occurred. The Law of Ukraine "On Copyright and Related Rights" defined two possible methods for calculating compensation and also provided that its amount must be effective, proportionate, and deterrent, and aimed at restoring the violated rights.Compensation must be applied in such a way as to avoid creating obstacles to the lawful activities of the user while at the same time ensuring protection against abuses on their part.It is a measure of civil liability and therefore must be neither a punishment for the infringer nor a cause of suspension of their lawful activity due to an excessive financial burden. For this reason, the "proportionality requirement" is an important principle that requires separate study aimed at forming established law-enforcement approaches in this area.Within the framework of this article, the following questions are considered: the essence of the proportionality requirement for compensation; its impact on the process of establishing the quantum of compensation; and the application of this requirement to different methods of calculating compensation. Conclusions are drawn that the category of "proportionality," with respect to compensation determined as a multiple of the subsistence minimum for working-age persons, should be understood as "fair" compensation taking into account the objective circumstances of the infringement and its negative consequences. If compensation is claimed in the amount of double or triple the fee that would have been paid for the authorization to use the work, then establishing proportionality means demonstrating the amount of lost profits. The latter must be real, foreseeable, expected, and equivalent in nature.Compensation to the rights-holder, regardless of the method of calculation, must fulfill the compensatory function of civil liability and preclude any unjust enrichment of the claimant.
