Abstract: 随着互联网技术的飞速发展，网络直播行业异军突起，成为数字经济的重要组成部分。网络直播打赏作为该行业独特的盈利模式，在为主播、平台带来丰厚收益，推动行业繁荣的同时，也衍生出一系列复杂的法律问题，如法律性质界定模糊、未成年人打赏纠纷频发、直播内容低俗诱导打赏等，严重影响了网络直播行业的健康生态与参与者的合法权益。本文通过对网络直播打赏行为的深入剖析，结合现行法律法规与司法实践，明确其法律性质，梳理相关主体的权利义务关系，针对存在的问题提出完善法律规制的具体建议，旨在构建一个公平、有序、健康的网络直播打赏法律环境，为行业的可持续发展与参与者权益保护提供坚实的法律保障。With the rapid development of Internet technology, the online live-streaming industry has emerged as a prominent force and become an important part of the digital economy. As a unique profit-making model in this industry, online live-streaming rewards not only bring substantial earnings to hosts and platforms, promoting the prosperity of the industry, but also give rise to a series of complex legal issues. For example, the legal nature of such rewards is vaguely defined, disputes over rewards given by minors occur frequently, and vulgar content in live-streaming is used to induce rewards. These issues seriously affect the healthy ecosystem of the online live-streaming industry and the legitimate rights and interests of its participants. This article conducts an in-depth analysis of online live-streaming reward behaviors, clarifies their legal nature by combining existing laws, regulations, and judicial practices, sorts out the rights and obligations of relevant parties, and puts forward specific suggestions for improving legal regulations in response to the existing problems. The aim is to establish a fair, orderly, and healthy legal environment for online live-streaming rewards, providing solid legal guarantees for the sustainable development of the industry and the protection of participants’ rights and interests.
