Abstract: Стаття присвячена висвітленню одного з актуальних питань сучасної юридичної науки, а саме проблематиці громадянства України.У даній роботі автором проаналізовано сутність поняття громадянства з точки зору різних дослідників.До того ж, автор звертає увагу на законодавство, що стосується питань громадянства та аналізує положення Закону України «Про громадянство України».Разом з тим, автором запропоновано власний підхід до розуміння поняття громадянства України.Автором досліджено нормативну базу, яка регулює питання громадянства, зокрема: Конституція України, міжнародними договорами України (Європейська конвенція про громадянство), Закон України «Про громадянство України», Закон України «Про Єдиний державний демографічний реєстр та документи, що підтверджують громадянство України, посвідчують особу чи її спеціальний статус», Закон України «Про забезпечення прав і свобод громадян та правовий режим на тимчасово окупованій території України».Автором зазначено, що законом чітко визначено, хто є громадянином України.Разом з тим, автор звертає увагу на умови набуття громадянства України, зокрема встановлено, що громадянство України набувається: за народженням; за територіальним походженням; внаслідок прийняття до громадянства; внаслідок поновлення у громадянстві; внаслідок усиновлення; внаслідок встановлення над дитиною опіки чи піклування, влаштування дитини в заклад охорони здоров'я, заклад освіти або інший дитячий заклад, у дитячий будинок сімейного типу чи прийомну сім'ю; внаслідок встановлення над особою, визнаною судом недієздатною, опіки; у зв'язку з перебуванням у громадянстві України одного чи обох батьків дитини; внаслідок визнання батьківства чи материнства або встановлення факту батьківства чи материнства; за іншими підставами, передбаченими міжнародними договорами України.Також автор досліджує умови натуралізації.Ключові слова: громадянство, політико-правовий зв'язок людини і держави, взаємні права та обов'язки, належність особи до певної держави, зв'язок, що не обмежений у часі та просторі, приналежність, підстави набуття громадянства України натуралізація.The article is devoted to highlighting one of the topical issues of modern legal science, namely the issue of citizenship of Ukraine.In this work, the author analyzes the essence of the concept of citizenship from the point of view of various researchers.In addition, the author draws attention to the legislation related to citizenship issues and analyzes the provisions of the Law of Ukraine "On Citizenship of Ukraine".At the same time, the author proposes his own approach to understanding the concept of citizenship of Ukraine.The author examines the regulatory framework that regulates citizenship issues, in particular: the Constitution of Ukraine, international treaties of Ukraine (European Convention on Citizenship), the Law of Ukraine "On Citizenship of Ukraine", the Law of Ukraine "On the Unified State Demographic Register and Documents Confirming Citizenship of Ukraine, Identifying a Person or Its Special Status", the Law of Ukraine "On Ensuring the Rights and Freedoms of Citizens and the Legal Regime on the Temporarily Occupied Territory of Ukraine".The author notes that the law clearly defines who is a citizen of Ukraine.At the same time, the author draws attention to the conditions for acquiring Ukrainian citizenship, in particular, it is established that Ukrainian citizenship is acquired: by birth; by territorial origin; as a result of acceptance into citizenship; as a result of renewal of citizenship; as a result of adoption; as a result of establishing guardianship or care over a child, placing a child in a health care institution, educational institution or other children's institution, in a family-type orphanage or foster family; as a result of establishing guardianship over a person recognized by the court as incompetent; in connection with the stay of one or both parents of the child in Ukraine; as a result of recognition of paternity or maternity or establishment of the fact of paternity or maternity; on other grounds provided for by international treaties of Ukraine.The author also examines the conditions for naturalization.Key words: citizenship, political and legal relationship between a person and the state, mutual rights and obligations, belonging of a person to a certain state, a connection that is not limited in time and space, belonging, grounds for acquiring Ukrainian citizenship, naturalization.
