Year: 2025
Type: article
Abstract: This article explores the prerequisites for reforming the legal institution of restricted use areas. It examines specific regulatory issues related to the coordination of activities within the boundaries of protected zones around electric power industry facilities, using a ruling of the Constitutional Court of the Russian Federation as an example, which addresses the inconsistencies identified in Russian legislation on this issue. The article proposes an alternative approach to implementing this ruling of the Constitutional Court of the Russian Federation. It also analyzes the mechanism introduced in the legislation of the Russia Federation that addresses restrictions on the movement of oversized vehicles within protected zones of electric power industry facilities and offers an alternative solution to this problem. Additionally, the article considers certain aspects related to discrepancies between Russian legal regulation and that of the Eurasian Economic Union, as well as the challenges of law enforcement regarding transitional provisions related to minimum distance zones around main or technological pipelines
