Challenges in outsourcing local spatial planning in Poland: is legal procedure the last remaining safeguard in the democratic decision-making process?
Year: 2025
Type: article
Abstract: This study examines the systemic vulnerabilities of Polish local spatial planning under outsourcing to the private sector, focusing on the implications for the democratic decision-making process. Through critical legal analysis and semi-structured interviews conducted with 30 planning professionals, the research identifies six soft-spots in legal frameworks and procedural practices that undermine transparency, accountability, and public interest. Key findings reveal weakened hierarchical planning, underregulated professional qualifications, and procedural ambiguities, highlighting risks to participatory democracy. The study emphasizes the need for robust fail-safe mechanisms, including stronger legal safeguards, to ensure professional obligations of consultants and effective planning practices amid privatization pressures.
