Abstract: In the case of Poland v. Commission, the General Court of the European Union enshrines a principle of energy solidarity. Taking as starting point the general principle of solidarity between Member States, the General Court considers that the principle of solidarity is not limited exclusively to extraordinary situations but rather, the Union and the Member States acquire a general obligation to take into account the interests of other actors. In the field of energy, solidarity implies that both the Union and the Member States must avoid taking measures likely to affect the interests of the Union and other Member States as regards security of supply, economic and political viability and diversification of sources of supply or supply, in order to achieve de facto interdependence and solidarity.
