Abstract: This article analyzes the complex and evolving jurisprudence of the Federal Supreme Court (STF) regarding judicial oversight of public policies. It examines the transition from an initial stance of judicial self-restraint to a more interventionist approach, especially in the implementation of social rights. The objective is to provide an overview of how the Brazilian Supreme Court has navigated the delicate task of protecting the Constitution without becoming a positive legislator or public administrator.
