Type: article
Abstract: Article 280 paragraph (1) letter (h) of Law Number 7 of 2017 stipulates that election campaigns are prohibited from utilizing government facilities, places of worship, and educational institutions as venues for campaigning. The mosque, as one of the places of worship in Indonesia, serves functions beyond merely being a site for ritual prayer. This study examines the aforementioned prohibition from the perspective of Fikih Siyasah (Islamic political jurisprudence). The primary objective of this research is to analyze Article 280 paragraph (1) letter (h) of Law Number 7 of 2017 concerning the prohibition of utilizing mosques as campaign venues through the lens of Fikih Siyasah. This research employs a qualitative library-based method, utilizing a deductive approach. The findings indicate that, in essence, mosques may be utilized as spaces for political education. However, the legal prohibition against using mosques as campaign venues is consistent with the principles of Fikih Siyasah, aiming to uphold the sanctity of mosques as places of worship and to foster a conducive environment that prevents division and conflict within the fabric of national and societal life.
