Abstract: The legal criteria for opening insolvency proceedings have undergone numerous transformations throughout history. Colombian insolvency legislation bears witness to this ongoing evolution. By analyzing the way different insolvency statutes have regulated the topic, this article aims to offer some critical reflections on the suitability of the given indicators, the purposes they serve, and their impact on a debtor’s access to insolvency protection during times of financial distress.
