Abstract: The petitioners in the given cases had entered into marriages abroad and requested the Hungarian authorities to recognize these marriages as registered partnerships. The authorities rejected their applications, after which the petitioners turned to the courts, where their claims were also dismissed. According to the courts involved, the document submitted as the basis for the claims (certifying the marriage) could not be converted into a registered partnership, as there is no known rule of private international law that would allow such recognition. In its decision, the Constitutional Court found a constitutional omission that violated Article II and Article VI (1) of the Fundamental Law, due to the legislature's failure to make it possible for same-sex couples' marriages concluded abroad to be recognized in Hungary as registered partnerships
