Foreign Experience in Regulating and Organizing Prosecutors’ Activities in the Field of Defense and the Possibility of Its Use in Ukraine

Abstract: Покора К.В., аспірант кафедри публічного та приватного права, Східноукраїнський національний університету імені Володимира Даля У багатьох країнах світу діяльність військових прокурорів відіграє важливу роль у забезпеченні законності та дисципліни в збройних силах.Зарубіжний досвід організації такої діяльності може бути корисним для вдосконалення відповідної системи в Україні.Країни, які мають розвинуті та ефективні системи військової юстиції, зокрема, Сполучені Штати Америки, Велика Британія, Німеччина та Франція, можуть слугувати прикладами для вивчення та імплементації окремих елементів у вітчизняну практику.Зокрема, варто розглянути питання організаційної структури, повноважень, підпорядкування та взаємодії військових прокурорів з іншими правоохоронними органами та судовою гілкою влади.Особливий інтерес становить досвід держав, які нещодавно реформували свої військові прокуратури, адаптуючи їх до стандартів НАТО та ЄС.Це дозволяє проаналізувати актуальні тенденції та новітні підходи до регулювання діяльності військових прокурорів у сфері оборони.Розглядаючи зарубіжний досвід, слід приділити увагу повноваженням військових прокурорів.У багатьох країнах вони мають право не лише здійснювати нагляд та підтримувати обвинувачення у військових судах, а й проводити розслідування певних категорій злочинів, у тому числі військових.Надання таких повноважень військовим прокурорам в Україні може підвищити ефективність розслідування злочинів, вчинених військовослужбовцями.Водночас, важливо враховувати національні особливості та історичні традиції України, а також брати до уваги реалії гібридної війни, яку веде Російська Федерація проти нашої держави.Тому, використання зарубіжного досвіду має бути виваженим та адаптованим до українських реалій.Важливим аспектом є також організаційна структура військових прокуратур.У низці держав вони входять до єдиної системи органів прокуратури, проте мають спеціалізовану вертикаль управління та підпорядкування.Це сприяє ефективному виконанню завдань та дотриманню військової дисципліни.У контексті євроінтеграційних прагнень України, вивчення та імплементація кращих міжнародних практик у сфері діяльності військових прокурорів сприятиме зміцненню законності та дисципліни у Збройних Силах України, підвищенню їх боєздатності та ефективності, а також наближенню до стандартів НАТО.Ключові слова: діяльність прокурора оборонній сфері, прокурор в сфері оборони.In many countries of the world, the activities of military prosecutors play an important role in ensuring the rule of law and discipline in the armed forces.Foreign experience in organising such activities may be useful for improving the relevant system in Ukraine.Countries that have developed and effective military justice systems, such as the United States of America, the United Kingdom, Germany and France, can serve as examples for studying and implementing certain elements in domestic practice.In particular, it is worth considering the organisational structure, powers, subordination and interaction of military prosecutors with other law enforcement agencies and the judiciary.Of particular interest is the experience of states that have recently reformed their military prosecutor's offices to adapt them to NATO and EU standards.This allows us to analyse current trends and the latest approaches to regulating the activities of military prosecutors in the defence sector.When considering foreign experience, attention should be paid to the powers of military prosecutors.In many countries, they have the right not only to supervise and support prosecutions in military courts, but also to investigate certain categories of crimes, including war crimes.Granting such powers to military prosecutors in Ukraine could increase the effectiveness of investigations into crimes committed by military personnel.At the same time, it is important to take into account the national peculiarities and historical traditions of Ukraine, as well as the realities of the hybrid war waged by the Russian Federation against our country.Therefore, the use of foreign experience should be balanced and adapted to Ukrainian realities.Another important aspect is the organisational structure of military prosecutor's offices.In a number of countries, they are part of a unified system of prosecutorial bodies, but have a specialised chain of command and subordination.This contributes to the effective performance of tasks and the observance of military discipline.In the context of Ukraine's European integration aspirations, studying and implementing the best international practices in the field of military prosecutors' activities will help to strengthen the rule of law and discipline in the Armed Forces of Ukraine, increase their
