Legal Hypostases of an Individual in Modern Law
Year: 2025
Type: article
Abstract: The article substantiates that the terms "person", "personality", "person", "natural person" in the language of modern law are not absolute synonyms referring to an individual in the same legal hypostasis. They correspond to fundamentally different legal hypostases of an individual as a subject of law. At the same time, the concepts of "person" and "personality", which are considered to be the most universal names of an individual as a subject of law, actually turn out to be narrower in scope than the concepts of "person" and "individual", traditionally associated with legal civics, but in reality have long gone beyond its scope. The fact that "person" and "natural person" become not only generally accepted, but also the most universal names of an individual as a subject of law, negatively affects the perception of a person in law, creates prerequisites for the devaluation of what is associated with him and valuable specifically for him.
