Piddubnyi D. I. Cultural determinants of the use of mediation Introduction.Global experience demonstrates that mediation holds a leading position among alternative dispute-resolution mechanisms; however, in Ukraine, this institution is only beginning to acquire institutional and cultural legitimacy.Within the context of European integration and the ongoing transformation of national legal systems, a comprehensive analysis of the sociocultural determinants shaping the perception, acceptability, and practical effectiveness of mediation is of particular significance.Aim.This article seeks to identify and analyze the sociocultural factors underpinning the development of mediation through the analytical triad "cultural norms -regulatory environment -expected effectiveness," and to elucidate how these determinants influence the introduction of this social and legal institution in Ukraine.Methods.The research employs a dialectical approach, comparative-legal and formal-logical methods, and sociocultural analysis.Literature review. The cultural conditioning of mediation has been examined by K. Ohbuchi, O. Fukushima, and J. T. Tedeschi, who link the choice of conflictmanagement tactics to the value orientations of the parties.J. A. Wall, J. B. Stark, and R. L. Standifer have proposed a structural model of mediation integrating social, legal, and psychological factors. In multicultural settings, the effectiveness of the procedure has been explored by L. N. Mahan and J. M. Mahuna.Within Ukrainian scholarship, the cultural dimension of mediation is still nascent, yet studies by O. Spektor, T. Podkovenko, O. Karmaza, N. Sydorenko, and T. Kyseliova already emphasize the need to account for this factor during legal transformation. Results and conclusions. The study confirms three fundamental regularities.First, the parties' willingness to engage in mediation is shaped by social norms, the regulatory environment, and anticipated benefits for all participants.Second, although the choice of mediation is seldom purely rational, it is conditioned by society's normative-value orientations and the institutional culture of law enforcement.Third, the effective implementation of mediation requires a balanced interplay among cultural expectations, clear legal regulation, and demonstrable practical advantages. In the Ukrainian context, trust in mediation is determined by the cultural legitimacy of the mediator, the fragmented regulatory framework, and parties' modest expectations regarding the procedure's effectiveness.
