Abstract: Introduction. The lapidarity of the regulation of temporary suspension from work determined the problems of applying the norms of Art. 114 of the Code of Criminal Procedure of the Russian Federation. Purpose. The author's aim is to study some aspects of regulation and judicial practice of applying the norms of Art. 114 of the Code of Criminal Procedure through the prism of the preventive nature of temporary suspension from work. Methodology. The research was conducted in compliance with the principles of comprehensiveness, objectivity, pluralism and using a formal logical method and document analysis. Results. When making a decision, it is necessary to take into account the timeliness and expediency of temporary suspension from work, which will ensure the achievement of the purpose of its application and protect the suspect (accused) from unjustified restriction of his rights. Conclusion. The preventive purposes of applying temporary suspension is a criterion that optimizes and regulates the application of rules on temporary suspension from work.
