Anti-criminal cognition as a methodological basis for the relationship between criminal procedural and intelligence information

Year: 2025
Type: article
Abstract: Introduction. Modern criminal procedure increasingly faces the need to integrate information obtained within the framework of criminal intelligence into the system of criminal procedural evidence. However, there is no methodologically verified model to theoretically justify the legitimacy of such information. The existing disconnection between procedural and non-procedural forms of legal cognition hinders the development of a coordinated approach to using information about criminal activity. The article attempts to eliminate this theoretical and applied gap. Methods. The research is based on the epistemological analysis of legal information, logical-legal modeling, and the comparison of current norms with the cognitive nature of criminal proceedings. Elements of formal and dialectical logic are applied, and an interdisciplinary approach is used. Results. The author introduces and substantiates a new methodological category – anticriminal cognition encompassing both criminal procedural and criminal intelligence cognitive activities. Two fundamental principles of this category are identified: unity and continuity. The author proposes a normative perspective for recognising procedurally significant information as an element subject to transformation into admissible evidence. The concept of anti-criminal cognition can form the basis for reforming approaches to the admissibility of information obtained through criminal intelligence and for eliminating the methodological gap between forms of legal cognition..
