Casamento lavanda e a ausência do affectio maritalis

Year: 2025
Type: article
Abstract: The definition of marriage has evolved over time, traditionally associated with the foundation of a family. Currently, young adults have increasingly chosen so-called “lavender marriages”—strategic unions without the intention of forming a family, aimed at gaining social and legal benefits. This research study analyzed the legal validity of such marriages, based on the assumption that, since Brazilian law presumes the purpose of forming a family in marriage, its absence might invalidate such a union. A hypothetical-deductive method was used, drawing from a literature review and jurisprudential analysis. The study was set in three parts: the jurisprudential notion of family, a generational analysis of new types of marriage, and a jurisprudential examination of lavender marriage. This aimed to provide interpretive tools aligned with contemporary social changes. The hypothesis was confirmed.
