Abstract: From the early 16th century onward, the Apostolic Penitentiary broadened the scope of an office, which until this period had granted papal grace to tens of thousands of petitioners from all over Christendom. From then on, in hundreds of cases the office allowed church properties to be leased, especially in and around cities. In accordance with Roman law, the Penitentiary gave permission to clerics and laymen to use the form of the emphyteutic lease. This paper presents some examples from Naples and Rome that deserve further in-depth research.
