Abstract: Through many years of consulting, I have observed instances of life care planners working Medicare pricing/costs into a life care plan. Some planners have curtailed services, especially for medical equipment as a client ages, noting that Medicare would at that point reimburse the cost of that medical equipment. This curtailment is inappropriate not only for several reasons, but mostly because when a client receives a legal settlement, that settlement becomes the evaluee’s primary funding. The federal government then assumes a secondary role in funding medical services. As a matter of fact, if an evaluee used Medicare to pay for services previous to receiving a settlement, the evaluee is then required to reimburse Medicare for those previous payments upon case settlement.
