Abstract: Iranian criminal law contains distinct provisions that are contingent upon the gender of the offender or the victim. In certain offenses, when the accused or the affected party is female, significant divergences emerge in the sentencing, implementation of penalties, and the establishment or scope of criminal liability, compared to cases involving male counterparts. The central question this article addresses is: What specific rights are accorded to women under Iranian criminal law? The analysis is structured around two primary themes. First, it examines “Criminal Laws supporting women in the opinion of the Iranian Justice System,” encompassing: (A) “Differential criminal law for women versus men as offender,” and (B) “Laws specifically designed for women.” Second, it investigates “Gender discrimination against women under Iranian criminal law,” cataloging twenty-two legal provisions that exemplify these disparities. This research adopts a quantitative approach for its analysis.
