Redefining Medicolegal Practice: Navigating India's New Criminal Justice Framework
Year: 2025
Type: article
Abstract: The replacement of the Indian Penal Code (IPC), Code of Criminal Procedure (CrPC), and Indian Evidence Act (IEA) by the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA) marks a historic transformation in India’s legal landscape. These reforms have far-reaching implications for medical professionals who frequently intersect with the justice system. This review explores the key changes introduced by the new codes, particularly in areas such as medicolegal case documentation, sexual assault examination, forensic evidence handling, custodial death protocols, and postmortem procedures. The article also highlights the urgent need to revise medical education, hospital policies, and standard operating procedures to align with the updated legal framework. Through a critical examination of implementation challenges, including legal awareness, documentation standards, and institutional readiness—the paper proposes actionable steps to strengthen the medico-legal interface. As India ushers in this legal overhaul, legal literacy is no longer optional but a clinical imperative for modern medical practice.
