Abstract: This commentary aims at explaining the nature of Directive 2008/115 on common standards and procedures in Member States for returning illegally staying third-country nationals in the light of the Arib judgment of the Court of Justice of the EU, especially as far as the capacity of Directive 2008/115 to safeguard the rights of individuals is concerned.
