Abstract: Summary. This article explores the concept of the right historical memory as a part of nationalculture and authentic identity. The right to historical memory is crucial for social cohesion and theformation of national identity. In this study, we analyze the legal framework that safeguards the rightto historical memory in Republic of Moldova through the prism of the right to protection of culturalheritage, right to education, right to free access to information and the liberty of expression. Theanalysis focuses on how Moldovan legislation protects the right to historical memory through theprism of other rights, emphasizing the role of regulations, cultural policies, and educational programsin ensuring that the past is remembered and honored. This research highlights the necessity of theelaboration of the comprehensive policy of historical memory adapted to the political and socialrealities of current epoch.Key words: historical memory, legal framework, national legislation, cultural heritage, collective memory, cultural policies.
