Gender Issues in Fiqh Mawaris: Perspectives and Challenges in the Contemporary Context

Abstract: Fiqh mawaris or inheritance law in Islam has long been the subject of intensive study in various disciplines, especially in relation to gender issues. One of the main issues that arise in fiqh mawaris is the unequal distribution of inheritance between men and women. In classical Islamic inheritance law, men's share is usually double that of women, which has led to debates regarding gender justice and equality in modern society. This article aims to examine gender issues in fiqh mawaris, analyze the challenges faced in the interpretation of inheritance law, and explore the possibility of reform in the contemporary social context. Using an analytical and critical approach, this article will discuss various perspectives on Islamic inheritance law and its implications for gender roles in society.
