The Need for Trademark and Copyright Protection of Unique Human Genetic Information: A Case for A-PR2921 and L0
Year: 2024
Type: article
Abstract: Advances in genetic science have made human DNA a valuable commodity. Genetic sequences are now used for research, medical treatments, and even commercial purposes by pharmaceutical companies and research institutions. For individuals with unique genetic profiles—such as Ramon Moses, whose DNA includes the rare haplogroups A-PR2921 and L0—this presents a significant risk of exploitation. Without proper legal protections, these individuals have little control over how their genetic material is used, often leading to the commercialization of their genetic heritage without consent or compensation. This paper proposes that unique genetic information, particularly rare haplogroups like A-PR2921 and L0, should be protected under both trademark and copyright law. It presents a legal framework to protect this information from unauthorized commercial use and outlines what specific aspects of genetic data should be protected.
