Abstract: The issue of human rights protection on the African continent does not lose its relevance and is quite acute for both scientists and practitioners. Despite the fact that the world community has a fairly broad international legal framework for the protection of human rights, work in this area continues. The peculiarities of the region, along with the problems of the colonial past, include the fact that Africa has a rich system of traditional and customary law, as well as rules of conduct that are still used by indigenous peoples in some of its parts. Modern processes of globalization and regionalization have not become a stabilizing factor for the situation in the field of regional security, but on the contrary, have led to the aggravation of many deep-seated, ethnopolitical and ethno-confessional conflicts that have historically developed in this complex region. These problems have made Africa one of the most problematic regions in the field of human rights protection. The ethnic factor has also played a great role in the destabilization of the region. It should be emphasized that ethno-confessional conflicts are inextricably linked to the historical and colonial past of a particular state and ethnic group. The population of most African states is characterized by a motley ethnic composition, which does not contribute to their internal unity and political stability. Taking into account the complex regional conditions, the states of the African continent have developed a fairly broad international legal framework in the field of human rights protection, which, among other things, takes into account the great influence of the ethnic factor on socio-political relations in the region. Relevant institutions and mechanisms for the protection of human rights have also been created, in particular, the African Commission on Human and Peoples’ Rights and the African Court on Human and Peoples’ Rights. At the same time, the unresolved nature of most ethnic conflicts negatively affects the security situation and the problem of human rights on the African continent. At the heart of all ethno-political conflicts is the struggle for power and for material and financial resources. Contrary to expectations, the achievement of independence did not lead to a solution to the socio-economic problems of the population of former colonies. As a result, the issue of the distribution of resources between individual ethnic groups and regions, of changing the system of ethnic division of labor and ethnic stratification that developed during the colonial period, of overcoming the gap between centers of economic development and large backward regions came to the fore. These circumstances, as well as long-standing ethno-political and ethno-confessional problems, acquire a special resonance in connection with the new social, economic, demographic crises that challenge modern African states. At the same time, it can be confidently stated that the removal of the acuteness of the ethnic factor in socio-political relations will also contribute to the improvement of the situation in the field of human rights protection on the African continent and the security situation in general.
