Abstract: The article examines the determinants that influence the commission of criminal offenses in the insurance sector. The specified criminal acts infringe on the rights of individuals and the legitimate interests of insurance companies. If earlier, war risk insurance mostly covered sea and air transportation, risks for cargo, raw materials, and liability for possible losses during transportation, then under modern conditions, the relevant scope has expanded significantly, updated concepts and new rules have been introduced that take into account challenges in the security sector and cover a wider range of circumstances related to military events. In parallel with the introduction of the legal regime of martial law, the number of criminal offenses in the insurance sector has increased, in particular, their share has shifted to the sphere of personal insurance regarding conditional or real risks to the life and health of a person. The author emphasizes that the criminalization of the insurance market under martial law significantly hinders the performance of important functions by insurance, such as ensuring the stable operation of business entities, reducing financial and economic risks, and stimulating entrepreneurship and business initiatives. However, the increased crime rate in the insurance market complicates or blocks the implementation of tasks related to the formation, through monetary contributions, of an insurance fund intended for compensation for damage, equalization of losses due to the consequences of insured events, etc. It is stated that the elimination of the main causes and conditions that lead to the commission of criminal offenses in the insurance sector should be a comprehensive, continuous process that takes into account the specifics of the legal regime of martial law and the changes that occur in modern society and that affect the provision of insurance services. Attention is also drawn to the fact that the system of security entities in the insurance market itself covers a wide range of entities preventing various types of offenses. However, the author argues that their joint activities should correspond to a single purposeful criminological policy of the state, as a single set of actions to consistently eliminate negative military-political, socio-economic, organizational-managerial and other determinants of the destruction of social relations in the insurance sector.
