Правові форми запобігання порушенням суспільних інтересів у сфері діяльності інституційних інвесторів

Abstract: The article examines the following legal forms of preventing violations of public interests in the sphere of activity of institutional investors: the issuance of regulatory legal acts, the performance of legally significant actions, the conclusion of administrative and legal agreements. The full-scale invasion made Ukraine dependent on foreign aid, but it is very difficult to restore and maintain the public’s trust in the state in matters of investing funds in the national economy. This will allow our state to ensure a stable economy in wartime and to ensure financing of investment projects in post-war recovery. But citizens do not have the capital to independently implement large-scale projects, so it is important to unite them. Institutional investors are financial intermediaries who attract and accumulate funds from individual investors. Carrying out investment activities in the interests of groups of individual investors, institutional investors simultaneously act in the interests of the whole society through financing socially important sectors of the economy. However, sometimes business interests begin to prevail over public ones, then state intervention is required using the entire legal mechanism for protecting public interests. Proper formation and implementation of state policy in the field of institutional investment can prevent the emergence of such a conflict of interest. The author provides examples of the norms of current legislation that allow the implementation of large-scale investment projects, establish requirements for such investors and additional guarantees of the security of such investment. The procedure for performing certain legally significant actions is also enshrined in special legislation, for example, the possibility of stopping an investment project in the event of certain violations. The conclusion of administrative and legal agreements is very effective in preventing violations of public interests, as it allows combining the efforts of various state bodies at the national and international levels, as well as involving the public in resolving issues of public importance.
