Year: 2025
Type: article
Abstract: The study examines the application of confidentiality in Alternative Dispute Resolution (ADR) practices in Tanzania, with a focus on the applicable legal frameworks. It identifies the challenges that ADR practitioners face in maintaining confidentiality, such as gaps in legal enforcement, a lack of awareness of the norms of confidentiality, and ethical dilemmas. Additionally, the research compares practices in Tanzania with those of other jurisdictions. The study suggests that to ensure effective confidentiality in ADR processes, there is a need for strengthened regulations, improved training for practitioners, and consistent enforcement mechanisms. Furthermore, it emphasizes the importance of raising awareness and providing institutional support to enhance the integrity and trustworthiness of ADR in Tanzania.
