Abstract: This article delves into the implications of the United Kingdom's Illegal Migration Act 2023 on refugees, focusing on Section 2 of the Act. It analyses how this section impacts refugees seeking asylum in the UK unlawfully and examines its compliance with international laws, particularly the principle of non-penalty for unlawful entry and non-refoulement under the Refugee Convention. The paper argues for the exemption of refugees from punitive measures and deportation based on their mode of entry into the UK, advocating for individual case assessments and adherence to international obligations.
