Rethinking the Cybercrime Prevention Act of 2012

Year: 2024
Type: article
Abstract: The Cybercrime Prevention Act of 2012 was enacted to address the growing threat of cybercrime in the Philippines. However, the rapid advancement of technology has exposed the limitations of the Act in combating new and complex cyber threats. The policy brief examines the shortcomings of the current legal framework, emphasizing the need for a comprehensive review and reform. It highlights the Act's vague definitions and provisions, which fail to encompass emerging threats such as hacking, deepfakes, and AI-powered attacks. The brief also underscores the lack of proactive measures for prevention and the overemphasis on punitive actions. To strengthen the Philippines' sovereignty in the digital age, the brief proposes key recommendations, including redefining cybercrime offenses, updating investigative powers, enhancing educational outreach, and fostering international collaboration. The aim is to create a robust legal framework that effectively combats cybercrime while safeguarding civil liberties.
