A Distinct System for Presidential Succession on Inauguration Day: Getting the Most Out of Section 3 of the Twentieth Amendment
Year: 2024
Type: article
Abstract: The article argues that the current presidential succession statute fails to adequately address the unique challenges of inauguration day succession, particularly double vacancies. It advocates for a more nuanced approach, urging Congress to fully utilize the flexibility provided by Section 3 of the Twentieth Amendment to create tailored solutions for different succession scenarios, ensuring stability and democratic legitimacy.
