Abstract: The article argues that environmental due diligence (EDD) should be a mandatory precondition for investment treaty protection. Grounded in the ICJ’s 2025 climate advisory opinion, it calls for linking investor rights to environmental compliance, transforming investment law into a system of reciprocal responsibility aligned with global sustainability standards.
