KT4D How should tech be regulated?
Year: 2025
Type: article
Abstract: “Hard ethics” encompasses the “values, rights, duties and responsibilities” discussed when formulating regulation. “Soft ethics” in contrast, discusses the same values, rights, duties, and responsibilities not from a regulation point of view, but from a post-compliance angle - i.e., what should be done once existing regulation has been obeyed (Floridi, 2018). It is important to understand the evolving sphere of hard ethics as related to AI and big data. In what follows, we outline some ways that have been considered in the literature as methods to regulate the technology space including structural regulation and transparent algorithms, the current concentration of power to AI companies, and existing and emerging regulation.
