Cold Strategy, Early Cruelty: Machiavellian Traits, Emerging Psychopathy, and Legal Responsibility in Youth Aged 11–15
Year: 2025
Type: article
Abstract: Article Summary This article examines the implications of co-occurring Machiavellian traits and emerging psychopathic features, operationalized as callous–unemotional traits, in youth aged 11–15 within juvenile justice contexts. It addresses the tension between age-based assumptions of diminished culpability and evidence that a small subgroup of adolescents engages in calculated, proactive, and persistent antisocial behavior. Drawing on interdisciplinary literature from developmental psychology, psychiatry, and law, the article adopts a conceptual and analytic approach rather than original empirical analysis. It explores how strategic manipulation combined with emotional detachment complicates assessments of mens rea, risk, and treatment responsiveness. The discussion emphasizes ethical and developmental constraints on the use of psychopathy-related constructs in legal decision-making. The article contributes to scholarly and practical debates by highlighting the need for developmentally informed risk assessment and specialized intervention while cautioning against stigmatizing labels and punitive misuse in juvenile justice systems.
