Abstract: The author compares Slovak and EU legislation and points out the fields that appear to be problematic. It seems that the Slovak Media Act and the European DSA regulation perceive differently what is covered by illegal content. This could restrict the proper application of the DSA in the Slovak Republic. In the paper, particular attention is paid to disinformation and terrorist content. Based on the different perception of illegal content under the Slovak Media Act and the DSA, the author asks the question who should decide whether it is illegal content. Namely, in Slovakia, the Digital Services Coordinator and the authority issuing orders to act against illegal content are one and the same administrative authority. Finally, the author points to a third problem, namely which platforms are covered by Slovak or EU regulation.
