Abstract: الملخص يتناول هذا البحث دراسة الحماية القانونية والتشريعية المقررة لحقوق الأشخاص ذوي الإعاقة في النظم القانونية العربية والعالمية، في ضوء المبادئ الدستورية والمعايير الدولية لحقوق الإنسان. ويهدف البحث إلى إبراز الأساس القانوني لحقوق ذوي الإعاقة، وتحليل مدى التزام التشريعات الوطنية العربية بأحكام الاتفاقيات الدولية، ولاسيما اتفاقية حقوق الأشخاص ذوي الإعاقة الصادرة عن الأمم المتحدة. كما يستعرض البحث أبرز التجارب التشريعية المقارنة في بعض الدول، ويحلل أوجه القصور التشريعي والتطبيقي التي تعيق التمتع الفعلي بهذه الحقوق. ويخلص البحث إلى مجموعة من النتائج والتوصيات التي تؤكد ضرورة تطوير الأطر التشريعية، وتعزيز آليات التنفيذ والرقابة، بما يحقق المساواة وعدم التمييز، ويضمن الدمج المجتمعي الكامل للأشخاص ذوي الإعاقة باعتبارهم فئة فاعلة في المجتمع. Abstract This paper examines the legal and legislative protection of the rights of persons with disabilities within Arab and international legal systems, in light of constitutional principles and international human rights standards. It aims to clarify the legal foundations of disability rights and to analyze the extent to which Arab national legislations comply with international conventions, particularly the United Nations Convention on the Rights of Persons with Disabilities (CRPD). The study also presents selected comparative legislative experiences and identifies legislative and practical shortcomings that hinder the effective enjoyment of these rights. The paper concludes with a set of findings and recommendations emphasizing the necessity of developing legislative frameworks, strengthening implementation and oversight mechanisms, and ensuring equality, non-discrimination, and full social inclusion of persons with disabilities as active members of society.
