Correcting a Structural Inequity in Concurrent Retirement and Disability Pay (CRDP) for Chapter 61 Retirees

Year: 2026
Type: article
Abstract: This white paper analyzes a statutory inconsistency affecting Concurrent Retirement and Disability Pay (CRDP) for Chapter 61 disability retirees. Under 10 U.S.C. § 1201(b)(3), Congress explicitly treated a service-connected disability rated at 30 percent or higher as legally equivalent to 20 years of service for purposes of disability retirement eligibility. However, that equivalence was not carried forward when CRDP was implemented under 10 U.S.C. § 1414, resulting in the categorical exclusion of certain medically retired service members from concurrent receipt solely because their service-connected disabilities prevented them from completing 20 years of service. The paper is intentionally statute-focused and non-advocacy in nature, explaining how the inconsistency arose and how it could be resolved cleanly using Congress’s own existing language.
