Year: 2026
Type: article
The crime of hacking information systems is among the most significant modern technological offenses, necessitating the establishment of robust cybersecurity mechanisms to ensure the integrity of digital infrastructures and to mitigate the risks of intrusion and aggression. This study seeks to elucidate the concept and various manifestations of information system hacking, define cybersecurity and its objectives, and examine the principal forms of cyber intrusion—such as financial theft and cyber espionage—while demonstrating the necessity of safeguarding cybersecurity and substantiating this duty with Islamic legal evidence. The study further explores both technological and deterrent measures that contribute to minimizing and preventing such offenses. The research employs a multi-method approach that integrates descriptive, inductive-analytical, and comparative methodologies. The descriptive approach is used to clarify the conceptual framework of hacking and cybersecurity; the inductive-analytical approach traces and analyzes classical juristic opinions relevant to contemporary digital realities, thereby deriving Sharia-compliant rulings aligned with the objectives of Islamic law; and the comparative approach is adopted to assess differing juristic views and to favor the opinions best supported by legal evidence. Findings indicate the comprehensiveness and adaptability of Islamic Sharia in addressing modern technological developments. Hacking information systems is classified as one of the gravest cybercrimes, posing serious threats to information security and public interests. Its manifestations include theft, espionage, sabotage, and other harmful activities. The study also concludes that the classical condition of ḥirz (secure custody) in cases of traditional theft is analogously applicable to digital custody in cybercrimes, whereby technological safeguards—such as encryption and firewalls—serve as digital equivalents of physical protection, preserving assets and information. Furthermore, the punishment of a Muslim spy varies according to his circumstances and motives and is determined by the ruler in a manner that best achieves public welfare and prevents corruption. The study affirms that the primary objectives of cybersecurity are to safeguard wealth, maintain the confidentiality and integrity of data, and ensure the availability and stability of digital systems. Islamic legal evidence confirms the obligation to protect cybersecurity as one of the five essential necessities (al-ḍarūriyyāt al-khams) upheld by Sharia. Achieving this protection requires an integrated framework of preventive technical measures and deterrent legislative policies. Finally, the study recommends strengthening religious and ethical awareness, enhancing societal understanding of cyber threats, continuously updating security systems, organizing specialized academic forums, and enforcing stricter penalties on cyber offenders to promote deterrence and preserve digital interests.
