Abstract: يعنى هذا البحث ببيان القواعد الأصولية التي نص عليها القرافي بلفظ "قاعدة" في باب العموم والخصوص من خلال كتاب نفائس الأصول في شرح الأصول، وقد اعتمد الباحث على المنهج الاستقرائي التحليلي، وعقد تمهيدًا للتعريف بالإمام القرافي، وكتابه نفائس الأصول، وشرح مصطلحات العنوان. ثم عقد خمسة مباحث، ذكر تحت كل مبحث ثلاثة مطالب، مطلبٌ في نص القرافي، وآخر في سبب إيراد القرافي للقاعدة، والثالث في دراسة المسألة. ثم خلص الباحث إلى جملة من النتائج والتوصيات، من أهمها: مكانة القرافي العلمية فقد كان إمامًا بارعاً في الفقه والأصول، وأن القرافي قد ألف كتاب نفائس الأصول ليكون شرحًا لكتاب المحصول للرازي، يحرر فيه مسائله، ويبيّن فيه ما أشكل، ويستدرك ما فات عليه. وأوصى الباحث بأهمية العناية والاهتمام بكتاب نفائس الأصول، فالكتاب جدير بالعناية والدراسة، وهو مجال خصب للبحث، كما أوصى بدراسة ما نص عليه القرافي بلفظ "قاعدة" في باقي مباحث أصول الفقه، كما أوصى بدراسة الأسئلة المشكلة التي صرح القرافي بأنه لم يهتد فيها إلى جواب. This study aims to elucidate the foundational legal principles (qawāʿid uṣūliyyah) explicitly designated by al-Qarāfī with the term “principle” (qāʿidah) in the chapter on general and particular expressions (al-ʿumūm wa al-khuṣūṣ), as presented in his work Nafāʾis al-Uṣūl fī Sharḥ al-Uṣūl. The researcher adopts an inductive-analytical methodology. The study begins with a preliminary section introducing Imām al-Qarāfī, his book Nafāʾis al-Uṣūl, and an explanation of the key terms in the title. It then proceeds through five main sections, each comprising three sub-sections: the first presenting al-Qarāfī’s original formulation of the principle, the second examining his rationale for introducing it, and the third offering an analytical study of the issue. The research concludes with a set of findings and recommendations. Among the most significant findings are the scholarly stature of al-Qarāfī, who was a distinguished authority in both jurisprudence (fiqh) and legal theory (uṣūl al-fiqh), and that Nafāʾis al-Uṣūl was composed as a commentary on al-Rāzī’s al-Maḥṣūl, in which al-Qarāfī refines its discussions, clarifies problematic issues, and supplements what he deemed incomplete. The study recommends greater scholarly attention to Nafāʾis al-Uṣūl, as it is highly deserving of careful study and constitutes fertile ground for further research. It also calls for examining the principles explicitly labeled by al-Qarāfī as “qāʿidah” in other areas of uṣūl al-fiqh, as well as investigating the complex questions for which al-Qarāfī himself acknowledged that he had not reached a definitive answer.
