Year: 2026
Type: article
This research establishes the illegitimacy of Israel's successive wars on the Gaza Strip during the period (2008–2025), even assuming that Israel may rely on the principle of legitimate defence or the so-called theory of preventive defence, bypassing the issue of the legitimacy of its presence as an occupying power under international law, which prevents it from invoking legitimate defence against a people enjoying the right to self-determination and resistance. The research analyses the military facts in light of international law, focusing on Article 2(4) of the United Nations Charter and the Geneva Conventions on the protection of civilians and objects, and refutes Israel's claims regarding the legitimacy of its wars on Gaza, whether on the grounds of self-defence or preventive defence, as the latter is not internationally recognised. The former requires the occurrence of actual aggression that cannot be repelled peacefully, and does not justify the waging of war after it has occurred, with reference to the position of Islamic jurisprudence in regulating the concept of self-defence. The study concludes that these wars involved violations amounting to war crimes and did not meet the conditions for legitimate defence. It recommends activating international accountability, supporting the documentation of violations, and strengthening Arab and Islamic efforts politically and in the media to refute Israel's misleading claims of self-defence and reduce impunity.
