This research examines the various forms of unlawful interference with genetic fingerprinting (DNA profiling) within the framework of a comparative study. This topic raises numerous legal questions that frequently arise in the minds of members of society. Genetic fingerprinting, by virtue of the genetic information it contains, constitutes the subject matter of the right to genetic privacy, and accordingly falls within the scope of legal protection. This study is presented in two chapters. The first chapter addresses the nature of genetic fingerprinting. It is divided into two sections: the first section discusses the concept of genetic fingerprinting, while the second section examines its sources and the methods used for analyzing genetic fingerprints. The second chapter addresses the unlawful acts committed against genetic fingerprinting. This chapter is divided into three sections. Genetic information may be obtained through means that fail to comply with the conditions and circumstances required for conducting lawful genetic testing, or through disregard of the free and informed consent of the owner of the genetic fingerprint. Therefore, the first section examines unlawful genetic testing. However, genetic information may also be obtained in compliance with the conditions and circumstances of lawful genetic testing, and with due respect for the free and informed consent of the individual concerned. Nevertheless, there remains a risk of violating the sanctity of the human genome and the individual’s right to genetic privacy at subsequent stages. Accordingly, the second section examines unlawful acts related to the analysis of genetic fingerprints, while the third section examines unlawful acts arising from the use of genetic fingerprint analysis.
