Abstract: فهذا بحث متواضع تناولت فيه « دور المقاصد الشرعية للعقوبات المقررة على الجرائم وأثرها في حفظ القيم المجتمعية»، وقد تناولت فيه التعريف بالمقاصد الشرعية، وأقسامها، وعرفت القيم، وتصنيفها، وخصائصها، وأهم المؤسسات التي تعمل على تكوين القيم والتي يناط بها إكساب القيم، كما عرفت القيم الاجتماعية، وأهميتها، وبينت فيه العلاقة بين المقاصد الشرعية والقيم الأخلاقية، ثم تحدثت عن المقاصد الشرعية للعقوبات المقررة على الجرائم وأثرها في حفظ القيم المجتمعية، وتناولت فيه حد الْحِرَابَة، وعقوبة جريمة الْحِرَابَة، مقصد الشارع من حد الْحِرَابَة، وأثره في حماية المجتمع، وكذلك حد الزِّنَا، وعقوبة الزِّنَا، ومقصد الشارع من حد الزِّنَا، وأثره في حفظ القيم الاجتماعية، وتناولت أيضًا حد القذف، وبينت عقوبة القاذف، والمقاصد الشرعية للعقوبة المقررة على القذف، وتناولت الشذوذ الجنسي، وعقوبة الشذوذ الجنسي، والمقاصد الشرعية للعقوبات المقررة على جرائم الشذوذ الجنسي، ثم تناولت حد السَّرِقَة، وعقوبة السَّرِقَة، ومقصد الشارع في حد السَّرِقَة، وأثره في حفظ القيم الاجتماعية، ثم عرجت إلى حَدِّ شُربِ الخَمر، وعقوبة شارب الخمر، ومقصد الشارع من حد الخمر، وأثره في حفظ القيم الاجتماعية. This is a modest research in which I dealt with “the role of legitimate purposes in preserving societal values”, and it included the definition of legitimate purposes, their divisions, and defined values, their classification, and characteristics, and the most important institutions that work on creating values and that are entrusted with imparting values, as well as social values and their importance. In it, she explained the relationship between legal purposes and moral values, then talked about the legal purposes of the penalties prescribed for crimes and their impact on preserving societal values In it, it dealt with the limit of partisanship, the penalty for the crime of partisanship, the goal of the street from the limit of partisanship, and its impact on the protection of society, as well as the limit for adultery, the penalty for adultery, and the goal of the street from the limit of adultery, and its impact on preserving social values.
