Year: 2026
Type: article
Abstract: The text aims to analyze the Statute of the Portuguese Indigenous Peoples as an expression of the Portuguese colonial rationality. Based on Fanon’s critical theory, it is investigated how the Statute institutionalized racial inequality and selective citizenship through legal, symbolic and affective devices. The research adopts a qualitative approach, articulating documentary analysis, content analysis and hermeneutic-critical method. It is concluded that the Statute justified the inferiorization of Black, under the discourse of integration and progress. It operated as a tool of racial domination, reproducing the colonial logic. By regulating the work, education, language, and citizenship among colonized peoples, the Statute not only consolidated legal exclusion but also produced effects of alienation, inferiorization, and psychic violence, shaping subjectivities and restricting freedom. The Fanonian reading thus reveals that colonialism was not only expressed in the materiality of oppression, but also in the most intimate field of identity and desire.
