A Judicialização Das Relações Familiares: Dilemas Éticos Do Assistente Social Na Avaliação Da Alienação Parental E Guarda

Year: 2026
Type: article
Abstract: This article analyzes the ethical dilemmas faced by social workers in expert practice within Family Courts, focusing on custody disputes and allegations of parental alienation. The research discusses the phenomenon of the judicialization of affective relationships and the institutional pressure for the "psychologization" of the social, which tends to reduce complex relational conflicts to behavioral diagnoses. Through qualitative, bibliographic, and documentary research, the study investigates how technical autonomy and the ethics of alterity function as safeguards against the instrumentalization of professional knowledge. The results indicate that the identification of parental alienation requires a rigorous gender perspective to avoid the reiteration of violence against women. It concludes that social studies, based on historical totality, are essential to ensure that the "best interests of the child" are implemented as a human right, resisting the productivism and moralism of the justice system.
